BDS Terms and Conditions
- All orders shipped FOB Doylestown, PA USA. No freight charges included.
- Quote validity 30 days. Specifications and pricing subject to change without notice.
- Domestic orders are Terms Net 30 days. We accept three payment methods: 1. Check, 2. Free bank ACH transfer, 3. Credit Card (Visa, Master Card, American Express, Discover, or Apple Pay). We add a 3.5% credit card payment fee on all credit card purchases.
- Export orders are not shipped until Purchase Order is received and the invoiced funds are wire transferred into BDS account. Wire transfer charge $45.00.
- 18-inch diameter lighted windsock frames standard. 24-inch diameter and 36-inch diameter lighted windsock frames are available on special order.
- Country of Origin – USA.
- BDS Certificate of Compliance / Certificate of Conformity is $10.00. BDS Systems Inc. is a USA company and BDS products are made in the USA.
- BDS Certificate of Origin is $75.00. Exporter / Producer is BDS Systems Inc., a USA-based company.

- Material Safety Data Sheets – MSDS documents are only provided for our Solar Powered Lighted Windsock Systems when we supply a battery, if requested.
- BDS SYSTEMS INC warrants each of its products to be free from defective material and workmanship for a period of one (1) year, except windsocks made of nylon or other cloth material that have a warranty of ninety (90) days, from the date of shipment.

Terms and Conditions
In addition to any terms and conditions of our products contained in the Installation Instructions and Limited Warranty, by purchasing or using this BDS windsock system you agree to the terms and conditions available at www.LightedWindsocks.com/About-Us/Terms-Conditions/. These online terms and conditions apply to you from the time you purchase or use this BDS windsock system. There is an inherent risk of damage or injury involved in the installation and use of all windsock products.
Installation
BDS SYSTEMS INC. is not liable for any damages, injuries, or other losses that relate to the installation and are not covered by our Limited Warranty. Damage to the windsock system or other property, serious injury, or death may occur if our product is improperly installed.
- WARNING: Safety Checks
BDS SYSTEMS INC. prides itself on manufacturing the highest quality lighted and non-lighted windsock systems on the market. BDS windsock systems are sometimes exposed to some of the most extreme and harsh environmental conditions on earth. Even though we use the highest quality materials and latest engineering techniques to manufacture our windsock systems, environmental conditions can deteriorate our windsock products over time. Therefore, ongoing monthly safety checks are mandatory as follows: - WARNING: Windsock Frame and Pole:
- WARNING: Visual Inspection – Make sure no corrosion or rust exists. If this is present, replacement is mandatory. Damage to the windsock system or other property, serious injury, or death may occur when a falling object hazard exists.
- WARNING: Torque Inspection – Make sure all bolts and coupling are securely tightened. Loosening can occur with vibration over time. Damage to the windsock system or other property, serious injury, or death may occur when a falling object hazard exists.
- WARNING: Rotation Inspection – Make sure the windsock frame freely swivels in a 360-degree rotation. If this is not present you must rectify immediately, otherwise the BDS windsock system will not work as designed, thereby posing a significant safety risk for all those relying on this BDS windsock system for correct wind direction and approximate wind strength.
- WARNING: LED Light: Visual Inspection – Make sure the windsock light is illuminated during desired times. If the bulb is not lit, replacement is mandatory. If this is not present, the BDS windsock system will not work as designed, thereby posing a significant safety risk for all those relying on this BDS windsock system for correct wind direction and approximate wind strength.
- WARNING: Windsock: Visual Inspection – Make sure the windsock is not torn, tethered, or faded. If this is present, replacement is mandatory, otherwise the BDS windsock system will not work as designed, thereby posing a significant safety risk for all those relying on this BDS windsock system for correct wind direction and approximate wind strength.
Warranty
BDS SYSTEMS INC is not liable for any damages, injuries, or losses that relate to the installation and not covered by this Limited Warranty. There is an inherent risk involved in the installation and use of windsock products. For more information about damages, injuries, or other losses regarding the installation and maintenance of our BDS windsock products, please see Windsock Installation and Maintenance Safety Instructions.
BDS SYSTEMS INC warrants each of its products to be free from defective material and workmanship for a period of one (1) year, except windsocks made of nylon or other cloth material that have a warranty of ninety (90) days, from the date of shipment. BDS SYSTEMS INC will remedy any defect that becomes apparent under normal installation and operation, provided the item is delivered, transportation prepaid by the owner, to our factory for inspection. In all cases, BDS SYSTEMS INC will examine and be the sole judge of what constitutes defective material and workmanship. Defective material and workmanship under this warranty will be corrected free of charge, FOB our factory.
BDS SYSTEMS INC warrants each of its products under the FAA requirements (FAA Advisory Circular: 150/5345-27F) for wind cone assemblies in the environmental conditions listed below:
- Temperature. Any ambient temperature between -67°F (-55°C) and 131°F (+55°C).
- Wind. Wind speed up to 75 knots (140 km/hr or 86 mph).
This warranty does not extend to any equipment that has been subject to abnormal wear and tear, accident, neglect, abuse, misuse, improper installation, damage by an act of God (including by not limited to hurricanes, tornadoes, and lightning strikes), or used in violation of any instructions supplied by BDS SYSTEMS INC. BDS SYSTEMS INC assumes no risk or liability for equipment failure if the equipment has been modified or serviced by anyone other than BDS SYSTEMS INC or its authorized representatives or furnished or used in conjunction with anything other than genuine BDS SYSTEMS INC products or parts (including but not limited to the windsock).
Prior to return of equipment for warranty repair or replacement, a letter requesting Return Merchandise Authorization (RMA) must be sent to BDS SYSTEMS INC with an explanation of the fault, pictures if possible, purchase date, original purchaser’s contact information, and BDS invoice number.
This warranty represents the entire warranty of BDS SYSTEMS INC over the equipment it manufactures and takes precedence over all other warranties expressed or implied, and no person or representative is authorized to assume for BDS SYSTEMS INC any other obligation or liability in connection with the sale of such equipment. Repair or replacement of equipment as provided under this warranty is the exclusive remedy of the purchaser. BDS SYSTEMS INC shall not be liable for any incidental or consequential damage for breach of any expressed or implied warranty on this product. Except to the extent prohibited by applicable law, any implied warranty of merchantability or fitness for a particular purpose on the product is limited by the provisions and to the duration of this warranty.
